1. Acceptance

By accessing or using S.T.E.W.A.R.D. Tutor (the "Platform"), you agree to these Terms of Service. The Platform is operated by SPU Stewardship Holdings LLC, a Delaware limited liability company, d/b/a S.T.E.W.A.R.D. Consulting (the "Company"). If you are using the Platform on behalf of a school or district, you represent that you have authority to bind that organization to these terms.

2. Service description

The Platform provides AI-powered tutoring for K-12 students in Mathematics and English Language Arts, grades 3-8, across 12 states. AI responses are generated by third-party large language models and are educational estimates only — they do not constitute official assessments, grades, or educational recommendations. All AI outputs require teacher review before use in grading, placement, or reporting.

Adaptive learning features: The Platform adjusts instruction difficulty, scaffolding levels, and content recommendations based on student performance data. These adaptations are algorithmic estimates and may not accurately reflect a student's true ability level. Mastery scores, cognitive load estimates, diagnostic assessment results, readiness forecasts, and learning path recommendations are approximations — they do not replace teacher professional judgment, formal educational assessments, or clinical evaluations. Diagnostic pre/post assessments are not standardized, norm-referenced, or clinically validated instruments.

3. Subscription plans and billing

The Platform offers individual teacher plans (B2C) and school/district plans (B2B). Individual plans are billed monthly or annually through Stripe. Prices are listed on the pricing page. Annual plans include a discount and are billed as a single payment. All prices are in USD.

Free trial: New teachers receive a 7-day trial with full Starter features. No credit card is required. The trial converts to a free account with limited features after 7 days — you will not be charged without explicit action.

Cancellation: You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial months. Annual subscriptions may be refunded within the first 30 days.

Pilot program: Teachers enrolled in the S.T.E.W.A.R.D. Pilot Program are subject to the separate Pilot Program Agreement.

4. Acceptable use

You agree not to: create fake student accounts, submit fraudulent or AI-generated testimonials, attempt to bypass safety filters or governance controls, use the Platform for purposes other than educational instruction, share your account credentials, or violate any applicable law.

5. Student data and privacy

Student data is governed by our Privacy Policy, FERPA, COPPA, and applicable state student data privacy laws. You are responsible for obtaining parental consent where required. The Company does not use student data for AI model training, advertising, or any purpose beyond delivering the educational service.

6. Intellectual property

The Platform, its design, code, and content are owned by the Company. AI-generated educational content produced for your students may be used freely within your educational practice. You retain ownership of any original content you create using the Platform.

9. Governing law

These Terms are governed by the laws of the State of Delaware. Disputes shall be resolved in the state or federal courts located in Delaware. The Company complies with all applicable federal and state student data privacy laws in the states where the Platform operates, as detailed in our Privacy Policy.

10. Changes to terms

The Company may modify these Terms with 30 days' written notice via email. Continued use after the notice period constitutes acceptance.
